Short answer: Yes — kratom is legal in Texas for adults 18 and older, under the Texas Kratom Consumer Protection Act. But the law bans synthetic alkaloids, including synthetic 7-OH, and products where 7-OH makes up too large a share of the alkaloid content.
The Texas Kratom Consumer Protection Act
Texas regulates kratom under Chapter 444 of the Health and Safety Code, enacted by House Bill 1097 and effective September 1, 2023. Under the law:
- Kratom products may not be sold to anyone under 18.
- Products may not be adulterated with dangerous non-kratom substances or contaminated.
- Products may not contain synthetic alkaloids, including synthetic 7-hydroxymitragynine.
- Products may not contain 7-OH at more than 2% of the total alkaloid fraction. Natural leaf is far below that level; many concentrated “7-OH” products are far above it.
- Products must carry labeling that meets the statute’s requirements.
Enforcement against 7-OH products
Texas officials have enforced these limits against concentrated products. In February 2026, the Texas Attorney General sued a retailer over products allegedly containing many times the legal 7-OH limit. Retailers selling high-7-OH tablets, shots or gummies face legal risk under Chapter 444 and consumer protection laws.
At the federal level, three synthetic 7-OH-related compounds were temporarily placed in Schedule I in August 2026, and an order covering 7-OH itself is pending. See Kratom vs. 7-OH.
What this means for consumers
- You must be at least 18 to buy kratom in Texas.
- Natural leaf powder and capsules are generally lawful if properly labeled.
- Products marketed around 7-OH content are the most likely to violate the 2% limit.
- Neighboring Louisiana bans kratom entirely, so do not carry it across that state line.
